Swinky Photography Booking Terms and Conditions

ENTIRE AGREEMENT: This agreement contains the entire understanding between Claire James (CJ) of Swinky Photography and you; the happy couple. It replaces any prior agreements that may have been made.

 

CONFIRMATION: A signed wedding contract and deposit are necessary to confirm the stated wedding services on the date above.

 

PRE-WEDDING CONSULTATION: This normally happens at the time of booking. You will outline broadly what is required and Swinky Photography will advise on planning, logistics and timings of the shoots throughout the day. You are welcome to keep in touch up until the time of the wedding with any new questions.

 

COOPERATION: Swinky Photography recommends that the wedding photographer be provided with a helper (usually the Best man/woman) who will point out key individuals to be photographed. The photographer may also require the assistance of them in organising family groups. Please agree to give the photographer sufficient warning of key events at the wedding to give the photographer time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at weddings like having their photo taken and in such cases the wedding photographer will use her discretion but cannot be held responsible for a lack of photos of these individuals.

 

THE SCHEDULE: My shooting schedule, style of working and experience are designed to achieve a mouthwatering set of wedding photos for you; accomplished with good humour and enjoyed by all concerned. Both you and Swinky Photography therefore agree that punctuality and cheerful cooperation are essential to producing outstanding photographic results. In cases where the wedding does not run on time (for example, extreme lateness by bride or groom arriving to the church) I cannot guarantee to take the normal set of photos although in such circumstances I will do my absolute best to compensate: NB: no extra charge will be made for the day extending on after the agreed timeframe.

 

HOUSE RULES: Note that your photographer is sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example, some ministers insist that no flash photography is allowed, and others will insist that the photographer shoot from a specific location. In such circumstances you agree to accept the technical limitations that may be imposed on the equipment used. I advise that the you make yourselves aware of the rules of the venue concerned and if necessary negotiate with the individual concerned.

 

COPYRIGHT LAW: English Copyright Law states that the copyright of photographs remains with the photographer. Copyright ownership of your wedding photos is transferred to you upon full payment under the following conditions. The digital images taken by Swinky Photography are for personal use by you and your friends and relatives. Swinky photography can still use images for marketing purposes and on social media without prior approval to promote the business.

 

MODEL RELEASE: You hereby grant CJ at Swinky Photography and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of you for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. You hereby release Swinky Photography and its legal representatives, heirs and assigns from all liability and claims in connection with the images.

 

 LIMIT OF LIABILITY: If the photographer is too ill or becomes injured and cannot supply the wedding services specified above, Swinky Photography will do everything possible to book a replacement-wedding photographer. Under normal circumstances a second photographer is already on standby for the day. If a replacement photographer cannot be found in these circumstances, liability is limited to a refund of any payments received.

Swinky Photography has working methods in place to prevent the loss or damage to your images (the digital images are backed up constantly to separate storage media throughout the wedding, duplicate equipment is on hand in case of breakage or failure). However, there exists the unlikely possibility that images may be lost, stolen or destroyed for reasons beyond the control of Swinky Photography. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of original images supplied.

 

UNFORSEEN CIRCUMSTANCES: If an unforeseen external problem arises on the day that prevents CJ or a Swinky Photographer reaching the agreed venue/s on time you agree to compensate Swinky Photography with an amount deemed necessary (and within reason) to ensure she gets to the venue on time– examples of this might include a road traffic accident and CJ needing a taxi or no parking available in an agreed location at the ceremony and CJ needing to pay for parking. Please note that Swinky Photography will not be held responsible for any challenges arising due to the weather. Please note I will always do my best to overcome any challenges with the utmost professionalism and discretion.

 

BOOKING DEPOSITS: In the event of the wedding being cancelled for whatever reason the booking deposit is non-refundable.

 

DELIVERY OF IMAGES: The final images will be uploaded onto a professional online location to be downloaded by you. Finished edits can take between 4-8 weeks depending on the season.
